Environmental Site Assessments for Real Estate Transactions

A Phase I Environmental Site Assessment is a process of evaluating the environmental condition of a property and assessing potential liability for contamination.  In order to assess potential environmental liabilities associated with a real estate acquisition and ownership, most buyers and financial lending institutions require that a Phase I Environmental Site Assessment be performed for the property.  Phase I assessments are undertaken to demonstrate due diligence and to obtain protection from potential liability under CERCLA as an innocent landowner, a contiguous property owner, or a bona fide prospective purchaser.

 

The USEPA established federal standards in November 2005 for conducting All Appropriate Inquires (AAI), which are effective November 2006.  The American Society for Testing and Materials (ASTM) revised their Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process in November 2005 to address the requirements of the new federal rule.  Evans Mill Environmental, LLC conducts Phase I assessments in accordance with the ASTM E1527-05 standard and the AAI Final Rule, and can expand the scope of assessments to satisfy specific lending institution requirements and the unique aspects of a property.

 

Our staff of experienced engineers, geologists, and scientists meet and exceed the specific educational and experience requirements of the Environmental Professional, as defined by the federal rule.  Our company also has the capabilities to perform site specific sampling, site characterization, remediation, and other Phase II work efforts.
